Born Free Cycles – In‑Store Terms and Conditions

These Terms and Conditions apply to all services, parts purchases, deposits, storage, diagnostics, and repair work performed by Born Free Cycles (“Born Free Cycles,” “we,” “our,” or “us”). These terms are incorporated by reference into every Repair Order (RO) signed by the customer.
By authorizing service, purchasing parts, leaving a motorcycle in our care, or paying a deposit, you agree to the following terms.
1. Authorization for Work
Customer authorizes Born Free Cycles to perform the services listed on the Repair Order, including diagnostics, labor, parts installation, and road testing where necessary for quality control.
Additional repairs may be authorized verbally, electronically, or in writing unless a written spending limit is specified on the Repair Order.
Diagnostic authorization includes approval for disassembly necessary to determine repair needs.
2. Diagnostic Authorization
Unless otherwise stated in writing, motorcycles dropped off for diagnostic service authorize up to $298 in diagnostic and minor repair work, with a minimum diagnostic charge of $75.
If repairs exceed the authorized amount, additional approval will be requested prior to continuing work.
Diagnostic charges are non‑refundable.
3. Deposits and Special‑Order Parts Policy
All special‑order parts require full payment in advance.
Born Free Cycles may require a labor deposit of up to 50% for extended or multi‑day repairs.
Deposits are non‑refundable once parts are ordered or work has begun.
Parts not picked up within thirty (30) days of notification are considered abandoned and may be forfeited without refund.
4. Payment Terms
Payment in full is due upon completion of services unless otherwise agreed in writing.
Unpaid balances accrue interest at ten percent (10%) per month or the maximum amount permitted by law.
Born Free Cycles reserves all mechanic’s lien rights under California law and may retain possession of the motorcycle until payment is received.
Customer agrees to pay all reasonable collection costs, including attorney’s fees and court costs where permitted by law.
5. Storage Policy
Motorcycles must be picked up within five (5) calendar days after notification that service is complete.
Beginning on day six (6), a storage fee of $150 per day will apply whether or not the repair invoice has been paid.
Motorcycles left more than thirty (30) days after completion may be treated as abandoned property and handled in accordance with California lien sale procedures.
6. Test Ride Authorization and Release of Liability
Customer authorizes Born Free Cycles employees to operate the motorcycle for purposes including diagnostics, verification of repair, and quality control test riding.
Customer acknowledges motorcycles are inherently hazardous vehicles and assumes all risk associated with necessary road testing.
Born Free Cycles is not responsible for loss or damage resulting from normal operation during diagnostic or verification rides unless caused by gross negligence.
7. Limitation of Liability
Born Free Cycles is not responsible for loss, damage, or theft of motorcycles or personal property left with the vehicle except in cases of proven gross negligence.
Born Free Cycles is not liable for delays caused by parts availability, supplier issues, manufacturer backorders, shipping carriers, or circumstances beyond our control.
Customer acknowledges that older, modified, high‑performance, or custom motorcycles may involve increased diagnostic uncertainty and risk.
Born Free Cycles is not responsible for pre‑existing conditions, hidden damage, or failures unrelated to completed repairs.
8. Customer‑Supplied Parts Policy
No warranty applies to customer‑supplied parts.
Customer assumes all risk associated with the quality, compatibility, and performance of supplied components.
If a supplied part fails, customer is responsible for all removal, reinstallation, and replacement labor.
Born Free Cycles reserves the right to decline installation of any customer‑provided part.
9. Warranty – Parts and Labor
Installed parts purchased from Born Free Cycles are warranted for sixty (60) days or five hundred (500) miles, whichever occurs first.
Warranty coverage is limited to replacement of the defective part only and does not include refunds unless otherwise required by law.
Warranty does not include:
• Electrical components
• Used parts
• Clearance or close‑out merchandise
• Racing or competition components
• Normal wear items
• Damage caused by misuse, improper installation, accidents, or neglect
• Failures related to customer‑supplied parts
Warranty is void if any work affecting the repaired system is performed by anyone other than Born Free Cycles after service completion.
Manufacturer warranties may apply separately and are subject to manufacturer terms.
10. Returns and Exchanges – Parts and Merchandise
Returns must be requested within fourteen (14) days of purchase and require a valid receipt.
Approved returns must be:
• Unused
• Uninstalled
• In original packaging
• In resalable condition
The following items are non‑returnable:
• Electrical components
• Special‑order parts
• Installed parts
• Helmets
• Painted parts
• Sheet metal
• Leather goods
• Luggage and bags
• Kit components
• Clearance or sale items
• Drop‑ship items
Approved returns may be subject to a 20% restocking fee.
Refunds are issued to the original form of payment only.
11. Take‑Off Parts Policy
Customers requesting return of replaced parts must notify their Service Advisor at the time of vehicle drop‑off.
Take‑off parts must be retrieved within five (5) days after notification of completion.
Parts not retrieved within this period become the property of Born Free Cycles and may be discarded.
Condition of removed parts is not guaranteed.
12. Abandoned Property
Any motorcycle, part, or accessory left more than thirty (30) days after notification may be considered abandoned and processed according to California lien sale procedures.
Storage fees will continue to accrue until resolved.
13. Substitution of Parts
Born Free Cycles may substitute parts of equal or greater quality when necessary due to availability, supplier delays, or manufacturer changes.
Customer will be notified when practical.
14. Performance and Competition Parts Disclaimer
Installation of aftermarket performance components may affect emissions compliance, reliability, warranty status, and street legality.
Customer assumes responsibility for compliance with all local, state, and federal regulations.
Competition‑use components are sold for closed‑course use only where applicable.
15. Electronic Communications Authorization
Customer authorizes Born Free Cycles to communicate approvals, estimates, authorizations, and status updates via phone, text message (SMS), email, or electronic signature platforms.
Customer agrees that approvals transmitted electronically carry the same legal effect as written signatures.
Born Free Cycles is not responsible for delays resulting from missed communications when contact information provided by the customer is inaccurate or unavailable.
16. Additional Repairs Within Authorization Threshold
During the repair process, minor additional parts or labor necessary to safely complete the authorized service may be performed without further approval when such additions are reasonably required to complete the repair and remain within the authorized spending limit documented on the Repair Order.
If additional work exceeds the authorized amount, customer approval will be requested prior to continuing service.
17. Shop Supplies and Environmental Fees
A shop supplies charge may be applied to cover materials necessary to complete repairs, including but not limited to cleaners, lubricants, sealants, rags, disposal materials, and hazardous waste handling.
These charges reflect actual consumables used during service and are not itemized individually.
18. Arbitration Agreement
Any dispute arising from services performed by Born Free Cycles shall be resolved by binding arbitration through the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Los Angeles County, California.
Both parties waive the right to jury trial and participation in class actions.
This arbitration clause does not apply to small claims actions or enforcement of mechanic’s lien rights.
19. Governing Law
These Terms and Conditions are governed by the laws of the State of California.
20. Acceptance of Terms
By signing a Repair Order, leaving a motorcycle for service, purchasing parts, or paying a deposit, customer acknowledges they have read, understood, and agreed to these Terms and Conditions.
These Terms and Conditions are incorporated by reference into every Repair Order issued by Born Free Cycles.
